These inspections are now required by law to ensure the structural safety of elevated outdoor structures and prevent costly accidents or liabilities.

What Is SB326? (For HOAs & Condo Associations)

SB326, also known as the Balcony Inspection Law, applies to condominium associations (HOAs) with three or more dwelling units. It requires visual inspections of EEEs that are:

• Six feet or more above ground level

• Supported in whole or part by wood or wood-based products

Inspections must be conducted every nine (9) years by a qualified licensed architect, structural engineer, or waterproofing expert. These assessments identify visible damage, waterproofing failures, and structural deficiencies before they become major hazards.

What Is SB721? (For Apartment Buildings)

SB721 applies to apartment buildings with three or more units, requiring similar EEE inspections for balconies, decks, stairways, and walkways. This law mandates:

• Initial inspection by January 1, 2026

• Follow-up inspections every six (6) years

Inspections must be performed by a licensed contractor, architect, or engineer and documented with an official report.
